Welcome to the Center for Coaching Certification!

Thanks for using our products and services.  Because the quality of our products and services for you is a priority, these Terms of Services are written as an explanation and also to protect the integrity of our information, products, and services.

Please read these Terms of Services carefully before using the www.CoachCert.com website operated by the Center for Coaching Certification because by accessing this website and/or services provided you are agreeing to these terms of services, and access and use of the website and services is based on your acceptance of and compliance.  By accessing or using this website or services you agree to be bound by these terms.  If you disagree with any part of the terms you may not access the website or services.

We may terminate or suspend access to our website or service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms.

All provisions of the Terms of Service which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, copyright, confidentiality, indemnity, and limitations of liability.

Herein the Center for Coaching Certification is referred to as CCC.

About these Terms

CCC reserves the right, from time to time, with or without notice to you, to change these Terms of Service at our sole discretion. CCC may change these or any additional terms that apply to a product or service at any time for any reason and changes will be posted here so look at the terms regularly. If you do not agree to the changed terms, discontinue your use of the product and/or service. The most current version of these Terms of Service is posted on the site. Your use of the CCC websites after changes are made means that you agree to be bound by such changes.

Failure on the part of CCC to take action right away for your noncompliance does NOT mean that CCC is giving up any rights we have including but not limited to taking action in the future.

If any part of these terms is unenforceable it will not affect any other part of these terms.

The laws of Florida will apply to any disputes and any disputes will first go to mediation and then be litigated exclusively in the federal or state courts of Florida.

Acceptance of Terms of Service

These Terms of Service govern your use of all websites, products, and services published or offered by CCC. By using, visiting, or browsing CCC’s websites, you accept and agree to be bound by these Terms of Service. If you do not agree to these Terms of Service, you should not use CCC's websites, products, or services.

Using our Services

You must follow all policies made available to you on this website, in materials, documents, recordings, and during training.  Additionally, you must comply with the International Coaching Federation Code of Ethics.

You may use our products and services only as permitted by law. We may suspend or stop providing our products and services to you if you fail to comply with our terms or policies or if we suspect misconduct.

Using our Services does not give you ownership of any intellectual property rights in our products or services or the content you access. You may not use content from our website or services unless you obtain permission from CCC first or are otherwise permitted by law. These terms do not grant you the right to use any CCC branding or logos. Don’t remove, obscure, or alter any legal notices displayed in or along with our products or services.

Some CCC products and services may be accessed on mobile devices. Do not use such services in a way that distracts you or inhibits your ability to obey traffic and/or safety laws.

Copyright

The compilation of all content on this site, in CCC products, and in CCC services is the exclusive property of CCC and protected by US and international copyright laws. All content included on CCC's websites, in CCC class materials, CCC products, and in CCC services, including text, graphics, photographs, button icons, images, audio/video clips, logos, designs, digital downloads, data compilations, and software, is the property of CCC and is protected by United States and international copyright laws. You are prohibited from reproducing, redeveloping, sharing, or distributing any and all CCC information, content, or property without express written permission from CCC.

All class materials and resources provided to or made available for students are the exclusive property of CCC and protected by US and international copyright laws including but not limited to text, logo, PowerPoint slides, designs, info-graphics, handouts, photographs, graphics, diagrams, and recordings.  Students and graduates may use the material personally.  Students and graduates may not share the materials, distribute them to anyone, reproduce them, recreate them, or duplicate them without express written permission from CCC.

Confidentiality

CCC honors and is accountable to the ICF Code of Ethics.  This means that we maintain the strictest level of confidentiality with all personal information unless release is required by law. 

Disclaimers of Warranties and Limitations

CCC's websites and its contents are provided "as is" and we make no representations or warranties of any kind. CCC provides products and services with a commercially reasonable level of skill and care. There are certain things that we don’t promise including but not limited to any commitment about the appropriateness of products and services for your purposes.  CCC excludes all warranties. We assume no liability or responsibility for any errors or omissions in the content of CCC's websites, any interruptions, failures, or delays in the delivery of any content contained on CCC's websites, any losses or damages arising from the use of the content provided on CCC's websites, or any conduct by users of CCC's websites. We disclaim all representations and warranties, including, for example, non-infringement, warranties of merchantability, and fitness for a particular purpose. In addition, we do not represent or warrant that the information accessible via our sites is perfect, accurate, complete or current.

CCC will not be responsible for any losses or damages.  The maximum claim is the amount paid for services.

If use of our products or services is on the behalf of a business or organization, then that business or organization also accepts these terms.

You and a business or organization on whose behalf you use CCC products and services hereby agree to hold harmless and indemnify CCC, employees, independent contractors, vendors, and partners from any claim, suit or action from or related to the use of CCC products or services.

Disclaimer of Liability

You have the responsibility to check with applicable laws in your jurisdiction regarding whether the approaches we suggest meet legal or licensing requirements, or standards, in your jurisdiction.  The Center for Coaching Certification makes no claims about the amount you can earn as a coach. The coaching field is competitive, and the people in it have varying degrees of skill and ability. The Center for Coaching Certification is in no way liable or responsible for the business results you achieve. You understand that the information in this program is not meant to be a complete business plan. You should consult legal, accounting, other marketing professionals, and other resources to fully assess your risks.

Indemnification

You agree to indemnify, defend, and hold CCC and its subsidiaries, affiliates, officers, directors, agents, co-branders or other partners, employees, and representatives harmless from and against any and all claims, damages, losses, costs or expenses (including reasonable attorneys' fees and disbursements) which arise directly or indirectly out of or from (i) your breach of this Agreement, (ii) any allegation that any materials that you submit to CCC or post on message boards infringe or otherwise violate the copyright, trade secret, trademark or other intellectual property rights of a third party, and (iii) your access or use of the Sites and/or the Services. This indemnification shall survive in the event this agreement is terminated for any reason.  Because this program is just one step, Participant hereby agrees to indemnify and hold harmless the Center for Coaching Certification, their representatives or agents, for any actions resulting from independent work.  Participant further agrees that if there is a dispute or violation of this agreement, any legal action shall occur in the state of Florida.  The parties hereby agree to Mediation in Florida prior to the commencement of legal action.

The coach training and coaching certification offered by the Center for Coaching Certification includes Certified Professional Coach, Certified Master Coach, Certified Advanced Coach, Coaching Experience, Coaching Practicums, and Mentor Coaching as well as continuing education programs.  The core programs are offered in support of qualifying for membership with the ICF or for earning an ACC, PCC, or MCC credential with the ICF.
